German Citizenship

Germany is a founding member of the European Union, giving German citizens the right to travel, study, work and live in any of the 28 EU countries without any additional permits or documents. Many people belonging to the German Diaspora and who are descendants of German immigrants have the right to German citizenship regardless of where they were born or where they live.

There are over 50 million people of German ancestry living outside Germany, making the German diaspora one of the largest in the world, offering millions of potential German citizens living abroad the right to recover their German citizenship. Major populations of German ancestry can be found in the United States, Argentina, Brazil, Chile and other countries in the Americas. Other communities are present in South Africa, Czech Republic, Australia and New Zealand.

What are the benefits of German Citizenship

German citizenship provides numerous rights within the 28 countries of the European Union, the most important of which are:

Are you eligible?

The offspring of a German great grandfather, grandfather/grandmother or parents may be eligible for German citizenship. German Citizenship Law is based on the principle of “right of blood” (ius sanguinis), this means that a German descendant, might be eligible to acquire citizenship regardless of the place of birth and without limit of generations.

Up until January 1, 1975, when in wedlock, German Citizenship was only passed through men and passed only by women when they were not married at the time of birth of their children. However, recent changes in German Citizenship Law do allow the offspring of women whose children were born prior to 1975 if they meet some special requirements.

Special Laws for Persecuted People

As early as the 1930’s Germany enacted special laws for persecuted people, among them Jews, that allow a larger percentage of their descendants to reclaim citizenship. These laws refer to German Jews and others deprived of citizenship on political, racial or religious grounds.

On November 1941 Nazi Germany stripped Jews other people from their citizenship. This means that every German Jew was denaturalized and subject to deportation. After the end of World War II the right to citizenship was restored and Jews may claim citizenship through a naturalization process. If your ancestors were Jewish and naturalized after November 1941, you might still be eligible to apply for citizenship.

Recovery of Citizenship in Other Cases

Most German nationals who naturalize to a different citizenship lose their citizenship. However, eligibility to recover German citizenship will depend on the naturalization date and the date of birth of the next generation.

These are a couple of examples of when you are eligible to claim German citizenship:

  1. If your great-grandfather was German, he naturalized after your grandfather was born, and you, your father and your grandfather were all born out of wedlock and never obtained another citizenship through naturalization.
  2. If your grandfather was German, your mother was born out of wedlock in the USA and you were born after September 1, 1975.
